This Wedding Contract (the "Agreement") is entered into by Ampersand Bakehouse located at 1808 Danforth Ave, Toronto, Ontario M4C 1H8 and (the "Client"). Ampersand Bakehouse agrees to prepare cake(s) and/or cupcakes as agreed upon and on time. The client agrees to pickup and pay Ampersand Bakehouse for the production of cake(s) and/or cupcakes. The following terms and conditions apply:

Wedding Order and Changes

Only the Client(s) or their wedding planners are authorized to place an order or make changes to the Agreement. No other individual (e.g. mother, father, mother-in-law, father-in-law, sibling, relative, friend, etc.) shall contact Ampersand Bakehouse directly regarding the order. 

Nonrefundable Deposit

A nonrefundable deposit of 50% is required to place an order and secure a pickup date. The remaining balance is due one (1) month prior to the pickup date. Any changes to the order are subject to availability, and must be made in writing no later than one (1) month prior to pickup and may incur additional charges. If an order is placed less than one (1) month prior to the pickup date, the entire amount of the contract is due the date the order is placed.

Cancellation Policy

Cakes cancelled more than one (1) month prior to the pickup date can be refunded up 50%. The 50% deposit will not be refunded. Cakes cancelled within one (1) month of the pickup date will not be refunded. In the event that something occurs to effect your scheduled event date – please contact us to discuss options. Communication is key, we understand things can come up that are out of your control, and will do our best to accommodate you.

Creative Liberties 

Please note that colours and design of actual cake may vary slightly due to the nature of edible components. We reserve the right to make certain creative changes to your final design for the sake of stability, structural integrity or other certain emergencies. Decorative finishes are done by hand and are subject to artistic interpretation.

Nonedible Decor

Client assumes full responsibility for making sure all nonedible cake décor, including but not limited to, flowers, cake toppers, and structural components, are removed from the cake before it is cut and served. 

Outsourced Florals

In the case of fresh flowers being added to the cake(s) onsite, the responsibility of flower safety and safe food practices will rest with the florist. Client acknowledges that fresh flowers are not a food product, and may contain pesticides, insects, dirt, or other contaminants. Ampersand Bakehouse is not responsible for any liability associated with fresh or artificial flowers.

Allergy Disclaimer

Ampersand Bakehouse products may contain or come in contact with milk, wheat, nuts, cocoa or other allergens. While every precaution will be taken in the cases of known allergies, it remains the full responsibility of Client to inform guests of possible allergens. Ampersand Bakehouse is not responsible for any allergic reactions.

Delivery Services

Ampersand Bakehouse does not provide delivery or setup services. All wedding deliveries are scheduled with Starling (trystarling.com), a local delivery service for specialty food products. 

Client will provide clear delivery instructions to the location and inform Ampersand Bakehouse of any adverse conditions or obstacles that may hinder the delivery and affect the quality of finished cake(s) and/or cupcakes. Client will provide the time frame in which the location will be accepting deliveries or the Client has access to the location. Client will provide a contact person along with their cell phone number to accept the delivery upon arrival. 

Ampersand Bakehouse will book the delivery with Starling with the information the Client provides. After delivery pickup, Ampersand Bakehouse assumes no responsibility for the condition of the cake(s) and/or cupcakes once it leaves Ampersand Bakehouse. 

Cake Care

After pickup from Ampersand Bakehouse, Client assumes full liability and responsibility for the condition of the cake(s) and/or cupcakes. Client agrees to make arrangements for a proper and secure environment for the cake. Cakes are heavy and require a sturdy table, and optimal room temperature of 75 degrees or below. We do not recommend that cakes be left outdoors for any length of time and is in no way responsible for any damage that may occur due to weather conditions or outdoor locations including but not limited to heat, humidity or insects. Cakes should never be displayed in direct sunlight.

Cake Stand Rentals

All rental items (cake stands, serving utensils, etc.) must be returned within one (1) week from the event. A $25 late fee will be assessed for each day late and a $100 replacement fee will be charged should any parts be damaged or not returned.

Failure to Perform Services

In the event Ampersand Bakehouse cannot or will not perform its obligations in any or all parts of this Agreement, they will immediately give notice to Client and excuse the Client of any further payment obligations. Ampersand Bakehouse will issue a complete refund based on the Services rendered thus far.

Maximum Damages

Client agrees that the maximum amount of damages he or she is entitled to in any claim relating to this Agreement are not to exceed the total cost of Services provided by Ampersand Bakehouse.

Force Majeure

Ampersand Bakehouse promises a product of high quality and service, but is not liable for unforeseen circumstances, including but not limited to inclement weather, transportation problems, illness, accidents, labor disputes or strikes, Acts of God, and other causes beyond reasonable control. A delay in transit shall not constitute grounds for a discount or refund.

Promotional Photographs

Ampersand Bakehouse reserves the right to use any photographs of the finished cake(s) for promotion without compensation.
